Scope Of Terms and Conditions
These Terms and Conditions (“Terms”) apply to your use of all features, products, services, software, mobile applications (Android & iOS), website, diagnostic tools, and related services provided by OBDSmart (“OBDSmart”, “We”, “Us”, “Our”). This includes, without limitation, any OBD diagnostic hardware, software, website features, and any additional services that may be offered now or in the future. By accessing or using OBDSmart, whether in India or internationally, you (“User”, “you”) agree to be bound by these Terms. If you do not agree, please stop using our Services immediately.
Changes to the terms
We reserve the right to modify, update, or amend these Terms at any time, entirely at our discretion. Any changes become effective immediately upon posting on our website or through our app. Your continued use of the Services after such updates signifies your acceptance of the modified Terms. We encourage you to review this page regularly to stay informed of updates.
Limitation of Liability
To the maximum extent permitted by applicable law:
- OBDSmart, including its affiliates, officers, directors, employees, agents, and licensors, shall not be liable to you or any third party for any indirect, incidental, special, or consequential damages, including but not limited to loss of data, vehicle damage, repair costs, or lost profits—even if advised of the possibility of such damages.
- Our total cumulative liability for any claim arising from your use of the Services shall not exceed the amount you paid to OBDSmart for the specific product or service in question (if any).
Usage of OBDSmart is at your own risk. The Services are intended only as diagnostic aids and must be used in accordance with your vehicle manufacturer’s guidelines and obey all local laws.
Return and Refund Policy
Hardware returns (where applicable):
- You may return any OBDSmart hardware product within 7 calendar days of delivery.
- The product must be in original packaging and in like-new condition.
- If the product or packaging is damaged, OBDSmart reserves the right to reject the return.
Refund processing:
- Once the returned item is received and inspected, refunds will be issued via bank transfer or to the original payment method within 7–10 business days.
App subscriptions:
- Subscription refunds are subject to the platform’s (App Store or Google Play) policy. Within 7 days of purchase, you may request a refund if the service has not been substantially used. After that, no refunds will be granted, except as required by applicable law.
Shipping & Delivery (for hardware)
We ship products to the delivery address you provide.
While we make every effort to ensure timely delivery, all shipping and delivery timelines are provided by third-party couriers. OBDSmart holds no liability for delays, damage, or losses occurring in transit.
Who we share your data with
You agree to indemnify and hold OBDSmart, its affiliates, officers, directors, employees, agents, and partners harmless from any claims, damages, liabilities, losses, and expenses (including legal fees) arising from:
- Your use or misuse of OBDSmart’s products or Services;
- Violation of these Terms; or
- Breach of any representations or warranties you make.
Force Majeure
OBDSmart shall not be held liable for any failure or delay in fulfilling obligations under these Terms due to events beyond our reasonable control such as natural disasters, governmental actions, war, epidemics, labor disputes, or other similar causes.
Data Collection, Use & Storage
We may collect, store, and process the following types of data when you use OBDSmart:
a) Data You Provide:
- Account information (name, email, contact number)
- Payment details (processed securely via third-party payment gateways)
- Vehicle details you manually enter
b) Automatically Collected Data:
- Diagnostic data retrieved from your vehicle’s OBD system
- App usage analytics and crash logs
- Device identifiers and IP addresses
c) Purpose of Data Use:
- To provide and improve our Services
- To generate diagnostic reports and vehicle insights
- For troubleshooting, security, and fraud prevention
- To comply with legal obligations
d) Storage & Retention:
- Data is stored on secure servers located in India and/or internationally
- Vehicle diagnostic data may be stored for up to 3 years or as required by law
- Personal data will be retained only as long as necessary for the purposes above
e) Data Sharing:
- We do not sell your data to third parties
- Data may be shared with trusted service providers for hosting, analytics, and payment processing
- We may disclose information if required by law or to protect our legal rights
f) Your Rights:
- You may request access, correction, or deletion of your personal data by contacting us at [support@obdsmart.in]
- Certain legal or contractual obligations may prevent immediate deletion
